These Terms of Use (“Terms”) govern your use of spicybraintest.com and the quizzes, content, and services we provide (collectively, the “Service”). By accessing or using the Service, you agree to these Terms. If you don’t agree, please don’t use the Service.

You must be at least 18 years old to use spicybraintest.com. If you’re between 13 and 17, you may only use the Service with the supervision and consent of a parent or legal guardian.

What the Service is (and isn’t)

The quizzes on spicybraintest.com are informal self-assessments designed to help you reflect on traits commonly associated with ADHD and Autism. Your results are a summary of your responses — not a diagnosis, not a clinical evaluation, and not a recommendation to seek or avoid any specific treatment.

A formal diagnosis of ADHD, Autism Spectrum Disorder, or any other neurodevelopmental condition can only come from a qualified healthcare professional who has conducted a thorough clinical assessment. Our quizzes do not replicate that process.

If your results make you curious about getting a professional evaluation, we encourage you to speak with a licensed psychologist, psychiatrist, or primary care physician who can provide appropriate assessment and support.

Using the Service

You agree to use spicybraintest.com lawfully and respectfully. You may not:

• Use the Service for any unlawful purpose or in violation of these Terms.
• Attempt to gain unauthorized access to any part of the Service, other users’ accounts, or our servers.
• Interfere with, disrupt, or overload the Service (for example, by scraping at unreasonable rates, running denial-of-service attacks, or injecting malicious code).
• Use automated tools, bots, or scripts to interact with the Service without our express permission.
• Submit false information (including fake email addresses) to obtain quiz results.
• Resell, redistribute, or commercially exploit the Service or our content without written permission.
• Harass, threaten, or harm other users or our team.
• Reverse-engineer or attempt to extract the source code or underlying logic of our quizzes.

Intellectual property

All content on spicybraintest.com — including the quiz questions, scoring logic, written content, graphics, logos, and design — is owned by SpicyBrainTest or our licensors and is protected by copyright, trademark, and other intellectual property laws.

You may view and share links to our content for personal, non-commercial use. You may not copy, reproduce, modify, distribute, publish, or create derivative works from our content without our written permission.

The SpicyBrainTest name and logo are trademarks of SpicyBrainTest. Other trademarks mentioned on the site belong to their respective owners.

Your submissions

When you submit quiz responses or send us messages, you retain ownership of that information. However, by submitting it, you grant SpicyBrainTest a worldwide, royalty-free license to use that information to provide the Service (for example, to generate your quiz results, send you emails, and improve our quizzes and content in aggregate).

We handle your personal information in accordance with our Privacy Policy.

Email communications

When you take a quiz, you consent to receive your results by email and to receive follow-up educational content and occasional updates from SpicyBrainTest. You can unsubscribe at any time using the link in any email.

We never use your email address for purposes beyond operating the Service and communicating with you about neurodiversity-related content. We don’t sell or share your email with third parties for marketing purposes.

Third-party links

The Service may include links to other websites (for example, the NeuroSpicy community on Skool). We’re not responsible for the content, privacy practices, or terms of third-party websites. When you leave spicybraintest.com, you do so at your own discretion.

No warranties

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied. We don’t warrant that:

• The Service will be uninterrupted, timely, secure, or error-free.
• The quiz results will be accurate, reliable, or useful for any particular purpose.
• The information and content on the Service will be accurate or up-to-date.
• The Service will meet your expectations.

To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of liability

To the fullest extent permitted by law, SpicyBrainTest and its owners, employees, contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service — including, without limitation, damages for lost profits, lost data, emotional distress, or any other intangible losses.

This includes, but is not limited to, decisions you make based on your quiz results. The quizzes are not medical diagnoses. If you make healthcare decisions based solely on a quiz result rather than consulting a qualified professional, you do so at your own risk.

In no event will our total liability to you for any claim arising from or related to the Service exceed one hundred U.S. dollars ($100), or the amount you have paid us in the past twelve months, whichever is greater.

Indemnification

You agree to indemnify and hold harmless SpicyBrainTest and its owners, employees, contractors, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.

Changes to the Service

We may modify, suspend, or discontinue the Service (or any part of it) at any time, with or without notice. We aren’t liable to you or any third party for any modification, suspension, or discontinuation of the Service.

Changes to these Terms

We may update these Terms from time to time. When we make material changes, we’ll update the “Last updated” date at the top of this page. Your continued use of the Service after an update means you accept the updated Terms. If you don’t agree to the updated Terms, please stop using the Service.

Termination

We may suspend or terminate your access to the Service at any time, for any reason, without notice — for example, if you violate these Terms or if we believe your use of the Service is harmful to others. You may stop using the Service and unsubscribe from our emails at any time.

Governing law and disputes

These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law principles. Any legal action or proceeding arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in California, and you consent to the personal jurisdiction of those courts.

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

Entire agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and SpicyBrainTest regarding the Service, and supersede any prior agreements.
